The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 19/2025, registered at Police Station – Kartala, District- Korba (C.G.) for alleged commission of offence punishable under Sections 318(4), 336(3), 338, 340(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023. 2. As per the prosecution story in brief, the partition of lands in the name of 10 persons were carried out by the concerned Patwari of Halka No.34 through his digital signature, hence FIR lodged against the present applicant and other persons. 3. The learned counsel for the applicant has argued that the applicant is innocent and has been falsely implicated in the case. He further submits PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.05.01 19:08:08 +0530 2 that the applicant was in no way involved in any illegal transfer of land in his name and, moreover, never visited the Patwari office nor submitted any application for mutation or partition. The applicant has no criminal antecedents and belongs to a respectable family. He also submits that the Patwari was known to the present applicant, and since the applicant was facing financial hardship, the Patwari, along with his friend, was instrumental in facilitating a loan in favour of the applicant. He also submits that loan account of the applicant has been opened by Axis Bank bearing Axis Account No.924030068415080 showing loan amount to the tune of Rs. 24,32,179/- as on 25.03.25, the applicant is regularly paying back the loan amount and recently has paid Rs 20.00 Lakhs to bank on 09.04.26. Hence, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that in this manner, the applicant/accused person, with deliberate intent, caused tampering of revenue records and got forged entries made, whereby the applicant/accused Domendra Prasad and other co-accused, showed the lands bearing Khasra Nos. 223/7, 265/7, 312/18, 503/10, 980/7 admeasuring 2.500, 2.430, 1.980, 1.560, and 1.852 hectares, and Khasra Nos. 223/12, 265/12, 312/13, 503/15, 980/12 admeasuring 2.500, 2.850, 2.400, 1.640, and 0.640 hectares in their respective names, and on the basis of forged loan passbooks, obtained loans from Axis Bank, Raipur (C.G.), further looking to the seriousness of the crime, the present anticipatory bail application of the applicant is liable to be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 3 6. Considering the facts and circumstances of the case, allegations levelled against the applicant, and from the perusal of the records available, it transpires that the allegations that the applicant, in connivance with the co-accused, deliberately tampered with revenue records and procured forged entries in their names, and further obtained loans from Axis Bank on the basis of forged documents, and looking to the seriousness and gravity of the offence, this Court is of the view that the present application for anticipatory bail is liable to be rejected. 7. Accordingly, the Anticipatory Bail application of the applicant – Domendra Prasad Dewangan, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 19/2025, registered at Police Station – Kartala, District- Korba (C.G.) for alleged commission of offence punishable under Sections 318(4), 336(3), 338, 340(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, is rejected.
