ANANTHAPURAM VILLAGE, LAKKIREDDIPALLE MANDAL, ANNAMAYYA DISTRICT - 516257 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring that the survey proceedings being conducted by respondents 5 and 6 pursuant to the applications filed by respondent No.7 and others, as illegal, arbitrary, violative of the principles of natural justice, violative of the provisions of the Andhra Pradesh Survey and Boundaries Act, 1923 and the rules framed thereunder, and offends Articles 14, 21 and 300A of the Constitution of India and are liable to be set aside and consequently directing the 3rd respondent to personally depute himself to conduct or cause to be conducted a fresh, fair, impartial, transparent and scientifically accurate survey of the petitioner's agricultural land admeasuring Ac.8.43 cents in Survey No.403 situated at Ananthapuram Revenue Village, Lakkireddipalle Mandal, Annamayya District, strictly in accordance with the said provisions and full opportunity of hearing to the petitioner, all boundary owners, after considering all the written objections filed by the petitioner and other boundary owners on merits, and after following the prescribed procedure of measurement in the presence of all concerned parties, and to submit a proper survey report to the competent authority with a direction to update the revenue records only on the basis of such legally conducted survey IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased directing respondents 2 to 6 not to interfere with petitioner's land in Survey No.403 of Ananthapuram Revenue Village, Lakkireddipalle Mandal, Annamayya District, pending completion of the survey by the Assistant Director of Survey and Settlements and Land Records and until fur the orders of this Hon'ble Court, pending disposal of the main Writ Petition Counsel for the Petitioner: 1. GP FOR REVENUE The Court made the following order: Heard Sri Katta Sudhakar, learned counsel for the petitioner and Sri Divya Teja, learned Assistant Government Pleader for Revenue, for the respondents 1 to 6. The notice in respect of the 7th respondent is dispensed with since no adverse order has been passed affecting the right or interest of the 7th respondent. 2. The above writ petition was filed with an apprehension that the 6th respondent may not survey properly. The 7th respondent made an application for conducting a survey in respect of Ac.16.86 cents in Sy.No.403 of Ananthapuram Revenue Village, Lakkireddipalle Mandal, Annamayya District. The notices dated 23.03.2026, 07.04.2026, 09.04.2026, 04.06.2026 and 18.06.2026 (Ex.P1) were issued to the petitioner. 3. Learned counsel for the petitioner would submit that the 7th respondent may influence the 6th respondent and, hence, the survey may not be properly conducted. 4. Learned Assistant Government Pleader for Revenue, on the other hand, would submit that the authorities adhered to the procedure contemplated under the Andhra Pradesh Survey and Boundaries Act, 1923, and issued notices to the petitioner and other boundary owners. The authority will survey strictly adhering to the prescribed procedure. He would further submit that, if the petitioner is aggrieved by the survey after the report is furnished, the petitioner can also file an appeal under the provisions of the Andhra Pradesh Survey and Boundaries Act, 1923, hereinafter referred to as the ‘Act’. 5. Thus, as seen from the material available on record, Ex.P1 notices were issued to the petitioner, being the neighbouring landowner, to attend the survey. The notices, Ex.P1, per se, are without any jurisdiction. The authority, by exercising the jurisdiction under the provisions of the ‘Act’, issued the notices. The petitioner can also submit his objections during the survey. If such objections are presented by the petitioner, the authority concerned shall consider the same by strictly adhering to the procedure under the Act or any Rules in vogue. 6. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
