This is the First bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No. 129/2025 registered at Police Station Cyber Range, Raipur, Civil Lines, District- Raipur (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5), 111, 3(5) of the BNS. 2. The case of the prosecution, in brief, is that based on information KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 received from the Indian Cybercrime Coordination Centre through the Cyber Police Portal (1930), in connection with action against mule bank accounts, Crime No. 129/2025 has been registered under Sections 317(2), 317(4), 317(5), 111, and 3(5) of the Bharatiya Nyaya Sanhita, 2023 at Police Station Civil Lines, Raipur, District Raipur (C.G.), and the same has been taken up for investigation. During the course of investigation, it was found that a bank account bearing No. 60488463829, maintained at Bank of Maharashtra, Raipur Branch (IFSC Code MAHB0002400), in the name of Ishika Singh, with registered mobile number 9111677267, had received a total amount of ₹8,38,088.50. It was further revealed that, in relation to a financial transaction of ₹9,000/- dated 19.06.2024 in the said bank account, the complainant Shaikh Shafik Shahabuddin along with two other persons had lodged an online complaint of cyber fraud on the Cyber Crime Portal/1930 under acknowledgement No. 21906240059678. It has also come on record that a total of 18 bank accounts in Bank of Maharashtra, Telibandha, Raipur, bearing IFSC Code MAHB0002400, have been identified as mule accounts. The main accused, Ishika Singh, in her memorandum statement, has stated that she had provided the said bank account to the co-accused persons. On the basis of the said memorandum statement, the present applicant has been arrested. 3. Learned counsel for the applicant submits that the Hon’ble Supreme Court in Criminal Appeal (SLP) No.4494/2025 has granted regular bail to identically situated co-accused, namely, Ishika Singh, and thereafter, on the ground of parity two co- 3 accused, namely, Avinash Tandekar and Krishna Ghodesawar have been granted bail by this Court vide orders dated 08.01.2026 and 28.01.2026 in MCRC Nos.148 of 2026 and 902 of 2026, and recently the co-accused namely Abhinav Nagwanshi has been granted bail by this Court in MCRC No. 3363/2026 vide order dated 15.04.2026 and the case of the applicant is similar to that of co-accused therefore, he prays that the present applicant is also entitled to be released on bail on the ground of parity. 4. On the other hand, learned State Counsel opposes the bail application and submits that the charge-sheet has been filed in the present case. He further submits that the applicant along with co-accused persons, was involved in organized cyber fraud and facilitated the diversion and circulation of proceeds of crime amounting to Rs.64,10,855/- by opening and using multiple banks accounts, but could not dispute the fact that co-accused, Ishika Singh has already been granted bail by the Hon’be Supreme Court in Criminal Appeal (SLP) No.4494/2025 and recently the co- accused namely Abhinav Nagwanshi has been granted bail by this Court in MCRC No. 3363/2026 vide order dated 15.04.2026. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. In compliance with the order dated 02.04.2026 passed by this Court, the concerned Investigating Officer has filed his affidavit stating that during investigation, it was found that a mule bank 4 account bearing No. 60499948663 maintained at Bank of Maharashtra, Raipur Branch, in the name of Kamleshwar Mugri, resident of Saddu, Raipur, with registered mobile number 8827668443, was used for illegal financial transactions, wherein an amount of Rs. 1,21,13,419/- was credited within a short span of time since its opening on 31.07.2024, out of which Rs.1,21,01,290/- was withdrawn by 31.12.2024, and multiple complaints including that of Hemakshi Makim and others regarding cyber fraud were registered on the National Cyber Crime Reporting Portal (1930), showing that the said account was used to receive defrauded money from victims across various States. It was further revealed that the said mobile number was issued in the name of the present applicant Sachin Kumar Giri, who in his memorandum statement admitted that on the inducement of co-accused Gopal Tandi, he procured and provided the SIM card for monetary consideration and investigation also disclosed that the applicant, in collusion with other accused persons, facilitated the use of bank accounts for committing cyber fraud, acted as a beneficiary of the defrauded amount and that incriminating material including bank transactions and seized documents establishes his active involvement in the offence, thereby indicating that he was part of an organized cyber fraud syndicate. 7. Considering the facts and circumstances of the case, nature and gravity of offence alleged against the applicant and also 5 considering the affidavit filed by the concerned Investigating Officer, further the fact that the Hon’ble Supreme Court in Criminal Appeal (SLP) No.4494/2025 has granted regular bail to identically situated co-accused, namely, Ishika Singh and thereafter, on the ground of parity two co-accused, namely, Avinash Tandekar and Krishna Ghodesawar have been granted bail by this Court vide orders dated 08.01.2026 and 28.01.2026 in MCRC Nos.148 of 2026 and 902 of 2026 and further recently the co-accused namely Abhinav Nagwanshi has been granted bail by this Court in MCRC No. 3363/2026 vide order dated 15.04.2026 and the case of the applicant is approx. similar to that of co-accused, further charge- sheet has been filed before the competent Court, as such, this Court is of the view that the applicant is entitled to be released on bail in this case. 8. Accordingly present bail application is allowed. 9. Let the Applicant-Sachin Kumar Giri, involved in Crime No. 129/2025 registered at Police Station Cyber Range, Raipur, Civil Lines, District- Raipur (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5), 111, 3(5) of the BNS, be released on bail on his furnishing a personal bond with two sureties in the like sum to the satisfaction of the Court concerned with the following conditions:- (i) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are 6 present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (ii) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him under Section 269 of Bharatiya Nyaya Sanhita. (iii) In case, the applicant misuses the liberty of bail during trial and in order to secure his presence, proclamation under Section 84 of BNSS. is issued and the applicant fails to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against him, in accordance with law, under Section 209 of the Bharatiya Nyaya Sanhita. (iv) The applicant shall remain present, in person, before the trial court on the dates fixed for (i) opening of the case, (ii) framing of charge and (iii) recording of statement under Section 351 of BNSS. If in the opinion of the trial court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the trial court to treat such default as abuse of liberty of bail and proceed against him in accordance with law. 10.
