The petitioner is apprehending his arrest in connection with Barhi Mahila P.S. Case No.13 of 2025 for the alleged offences registered under Section 64(2)(m) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned J.M.F.C., Hazaribagh. 3. Learned counsel appearing for the petitioner submits that the informant is a married lady and the petitioner and informant came into contact in December, 2024 itself on Instagram. He further submits that false allegation is made of establishing relationship on the pretext of marriage. He then submits that what has happened that was consensual in nature and even in Panchayati which was held in the presence of the victim, her husband and this petitioner it was agreed to delete the recorded video and photographs mutually. 2026:JHHC:12298 --2-- A.B.A. No. 1689 of 2026 On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposed the prayer and submits that on the pretext of marriage relationship was established. 5. There is no doubt that the lady is said to be married in spite of that relationship has been established between the petitioner and the lady, however, further allegations are there of making video and taking photographs and the allegation of blackmailing on the basis of the said video and photographs are there and on 14th August, 2025 again the video and photographs were captured by the petitioner. Even after the talk of panchayati of the earlier period prima facie it appears that further blackmailing was done and thereafter the FIR has been lodged. Having the friendship is one of the aspect, however, taking away the dignity and privacy of any lady is another aspect. 6. In the attending facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, hence, the prayer for anticipatory bail of the petitioner is hereby rejected.
