(2) By means of this writ petition, petitioner has sought the following reliefs:
“I. Issue a writ, order or direction in the nature of Mandamus directing the Chief Education Officer to implement enquiry report dated 27/05/2026 (Annexure no. 3 page no. 39- 41) of the Block Education Officer, Bhagwanpur (Haridwar) and to initiate appropriate proceedings in accordance with law.
II. Issue a writ, order or direction in the nature of Mandamus directing the respondent authorities to preserve and secure all relevant records, electronic evidence and financial documents, conduct forensic examination/audit, trace the financial trail, and take all consequential steps for protection of public property and public funds.
III. Issue writ order or direction in the nature of mandamus directing the respondents (District Magistrate Respondents No. 4) to decide the representation dated 13/07/2026 (Annexure no. 7 page no. 76-93).”

2026:UHC:6828 submits that the writ petition appears to be motivated, filed for achieving some other purpose. He further submits that petitioner does not have any locus standi in the matter and if there is enquiry report, then the competent authority shall consider the same and pass necessary order. He further submits that, according to petitioner himself, there is an FIR registered in PS Kaliyar Sharif in the year 2022 and the matter is under investigation.

Learned Counsel for the petitioner, however, submits that there is a government aided institution, which was allotted land by the State Government and the Manager of the said institution has transferred the land, without any authority of law.
(5) If what petitioner’s Counsel submits is correct, then petitioner would at liberty to make representation to District Magistrate within two weeks from today. If petitioner makes such representation, decision thereupon shall be taken, as per law, by District Magistrate within six months thereafter. It goes without saying that persons likely to be affected by the decision shall be given reasonable opportunity of hearing before any order is passed in the matter.
