ORAL ORDER
1. Memo is filed by the learned counsel for the petitioner. Memo reads as under : The Advocate for the Petitioner/Complainant most respectfully submits as follows:
1. That the above-captioned Criminal Revision petition was filed challenging the judgment of acquittal dated 02.02.2026 passed by the II Addl. District and Sessions Judge, Kodagu-Madikeri (Sitting at Virajpet) in Crl.Appeal No. 5056/2023, which set aside the conviction of the Respondent/Accused.
2. That the Registry has raised an office objection regarding the maintainability of the present proceedings in its current form.
3. In view of the technical/procedural objections raised by the Office, the Appellant/Complainant prays that this Hon'ble Court be pleased to permit the withdrawal of the above-numbered Criminal Revision petition, with liberty to file a fresh Criminal Appeal along with a petition for

Special Leave to Appeal as per Section 378(4) of the Cr.P.C., challenging the same judgment of acquittal.
4. It is further prayed that the Registry be directed to return the certified copies of the judgments and all original documents filed herein to the counsel for the Petitioner, to facilitate the filing of the fresh appeal.
WHEREFORE, it is humbly prayed that this Hon'ble Court may be pleased to take this memo on record and permit the withdrawal of the appeal with liberty as prayed for, in the interest of justice.
2. Placing the memo on record, revision petition is dismissed as withdrawn with liberty as prayed for.
3. Time spent before this Court shall be excluded while computing the period of limitation under Section 14 of the Limitation Act.
