2. The present application is for condonation of delay of 78 days in filing the present Family Court Appeal. The present Family Court Appeal seeks challenge to the judgment dated 14.05.2025 passed by the learned Family Court, Yavatmal in Petition No.B-4/2023 thereby rejecting the petition filed by the applicant-appellant for recovery of Streedhan, Gift Articles and Cash Gifts under Section 27 of the Hindu Marriage Act, 1955.
3. Shri Vikrant Pandey, learned counsel for the appellant submits that the applicant is a divorcee, who has not received any maintenance from the husband. The applicant is residing with her brother and is completely dependent upon him. The applicant is poor and hence could not approach a lawyer for filing the appeal and as such there is delay of 78 days in filing the present Family Court Appeal.
4. In our considered opinion, the aforesaid reasons which are stated by the applicant in the application for condonation of delay are found to be genuine and bonafide. Thus, the delay of 78 days caused in filing the Family Court Appeal is unintentional and accordingly, we condone the same as the applicant has made out the sufficient cause by explaining the delay. 5. The Registry is directed to register the present Family Court Appeal.
