The brief facts are that the petitioner and the respondents entered into an Investment Agreement dated 17.04.2020, whereby respondent no.1 was obligated to make periodic disclosures and furnish details pertaining to the financial health and affairs of the company to the petitioner. Disputes arose between the parties to the lis. The petitioner by notice dated 10.02.2022 invoked the arbitration clause contained in Articles 12.11 to 12.13 of the Agreement and initiated arbitration proceedings. Ms. Anita Sahani, Advocate (Mobile No. 9810113256) is appointed as the sole arbitrator and shall substitute the earlier arbitrator. 6. The fees of the learned Arbitrator will be governed by Schedule IV of the Act. Before entering upon reference, the learned Arbitrator will comply with Section 12 of the Act. 7. It is made clear that since this Court has not expressed any opinion on the merits of the rival claims of the parties, it will be open for the parties to file their respective claims/counter claims before the learned Arbitrator which will be considered in accordance with law. 8.
