For Petitioner(s): Mr.A.B.Rajasekaran For Respondent(s): Mr.D.Ravichander, SGP For R1 to R4 Mr.C.Jayaprakash Govt.Advocate For R5 and R6 R7 notice dispensed with ORDER This writ petition has been filed, challenging the impugned order dated 03.11.2025 passed by the fourth respondent, rejecting the petitioner’s request for taking action against the seventh respondent for misuse of OSR lands. 2.According to the petitioner, under the approved layout developed by the seventh respondent, OSR lands are being misused by the seventh respondent. The petitioner contends that some of the lands have already been sold by the seventh respondent to third parties. The said request has been rejected on the https://www.mhc.tn.gov.in/judis WP No. 10665 of 2026 ground that OSR lands remain to be vacant. The petitioner had earlier sought for survey and demarcation of the boundaries as well as for taking action against the seventh respondent for the alleged misuse of the OSR lands by them. 3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of respondents 1 to 4. Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of respondents 5 and 6. Since no adverse order is being passed against the seventh respondent, notice to the seventh respondent is dispensed with by this Court. 4.Admittedly, survey and demarcation of boundaries was completed by the fourth respondent, but the request for taking action against the seventh respondent for the alleged misuse of the OSR lands and for restoration of the same have been rejected. Admittedly, the competent authority for taking action against the seventh respondent for the alleged misuse of the OSR lands is the fifth respondent and not the fourth respondent, who has passed the impugned order. 5.In view of the same, necessarily, the petitioner will have to give a fresh representation to the fifth respondent to take action against the seventh respondent for the alleged misuse of the OSR lands and for restoration of the lands for public purposes. https://www.mhc.tn.gov.in/judis WP No. 10665 of 2026 6.Learned counsel for the petitioner on instructions would submit that the petitioner is willing to submit a fresh representation to the fifth respondent for the aforesaid purpose and he requests this Court to issue direction to the fifth respondent to consider the said representation, on merits and in accordance with law, after giving due consideration to the supporting documents produced by the petitioner. 7.No prejudice would be caused to the respondents if such a direction is issued to the petitioner to submit a fresh representation to the fifth respondent and to direct the fifth respondent to consider the said representation, on merits and in accordance with law, after giving due consideration to the supporting documents produced by the petitioner. 8.For the foregoing reasons, this writ petition is disposed of by directing the petitioner to submit a fresh representation to the fifth respondent seeking for taking action against the seventh respondent and for restoration of OSR lands in the subject layout, morefully disclosed in the affidavit filed in support of this writ petition, within a period of two weeks from the date of receipt of a copy of this order.
