Todi, learned counsel for the applicant. Also heard Mr. D. Chakraborty, learned counsel for the respondent/opposite party No.1 and Mr. A. Bhattacharjee, learned counsel for the respondent/opposite party Nos.3.1 to 3.3. This application under Section 151 of the Code of Civil Procedure is preferred by the applicant for releasing document Nos.2, 3 and 4, which were exhibited as Exhibits- B, C and D before the learned Trial Court in Title Suit No.133/2010 and tagged along with RSA No.128/2024, which is pending before this Court. Mr. Sahewalla submits that the document Nos.2, 3 and 4 being the Exhibits-B, C and D are required to be exhibited before the learned Trial Court in connection with Title Suit No.66/2022 and as such, he has contended to release the document Nos.2, 3 and 4, which are exhibited as Exhibits-B, C and D by keeping the attested copies of the same with the record of RSA No.128/2024. Mr. Chakraborty and Mr. Bhattacharjee submit that they have no objection. Accordingly, taking note of the submission of learned counsel for both the parties, it is provided that the document Nos.2, 3 and 4 being Exhibits-B, C and D in Title Suit No.133/2010, tagged with RSA No.128/2024, shall be released by keeping the attested copies of the same along with the RSA No.128/2024.
