2. The present application is for condonation of delay of 64 days in filing the present Family Court Appeal. The present Family Court Appeal seeks challenge to the judgment dated 06.03.2026 passed by the learned Family Court, Nagpur in Petition No.A-1526/2024. The learned Family Court, Nagpur, by virtue of the aforesaid judgment, has dismissed the petition filed by the appellant under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights.
3. Shri K.Y. Mandpe, learned counsel for the appellant has invited our attention to the grounds raised in paragraphs 3 and 4 of the present civil application whereby it is stated on oath that the applicant is a housewife having no independent source of income and was required to arrange funds for filing the present Family Court Appeal. The delay is of 64 days.
4. In our considered opinion, the applicant has sufficiently made out the case for condoning the aforesaid delay of 64 days in filing the present Family Court Appeal. The delay caused is bonafide and unintentional and no prejudice would be caused to the respondent if such delay is condoned.

5. In view of above and for the reasons stated in the civil application, we condone the delay of 64 days caused in filing the present Family Court Appeal. The civil application is allowed and
disposed of. The Registry is directed to register the present Family Court Appeal.
FAMILY COURT APPEAL STAMP NO.12901/2026. Once the Family Court Appeal is registered, issue notice to the respondent returnable on 07.10.2026.
2. To be heard with Family Court Appeal No.88 of 2025.
