The petitioner has preferred this writ petition under Article 226 of RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2026.05.02 17:06:42 +0530 2 the Constitution of India seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be issued a appropriate writ/writs, order/orders, direction/directions to quash order dated 17.03.2026 passed by Commissioner Surguja Division, Ambikapur, District. Surguja, C.G. (res. no. 2) in Rev. Revision Case No. 202411960100069/A-21/(5)/2024-25 "Badal Das Vs. Amit Kumar) (Annex. P/1) and may kindly be allowed revision (Annex. P/10) filed by the petitioner. 10.2 That, this Hon'ble Court may kindly be issued a appropriate writ/writs, order/orders, direction/directions to Collector Surguja, Ambikapur, District. Surguja, C.G. (res. no. 3) to decide application/case of petitioner (Rev. Case No. 160/A-21/2022-23 "Badal Das Vs. Amit Kumar" on merit within stipulated period. 10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief, which it deems fit and proper.” 2. Learned counsel for the petitioner submits that the petitioner is seeking permission by filing application under Section 165 (7-B) of the Chhattisgarh Land Revenue Code, 1959 (hereinafter referred to as “the Code, 1959”) for the sale of his land, which has been granted by the State under the rehabilitation policy. However, the said application has not been considered despite the recommendations made by the concerned Tahsildar as well the Sub-Divisional Officer (Revenue). She further submits that the concerned Collector has repeatedly been requiring additional documents along with the reports of the concerned revenue officers, which is not in accordance with law. Therefore, learned counsel for the petitioner prays that the concerned collector/respondent No.3 may be directed to decide the 3 application filed by the petitioner under Section 165 (7-B) of the Code, 1959, in accordance with law, on the basis of the recommendations made by the Tahsildar as well as the SDO (R), within a stipulated period. 3. In reply, learned counsel for the State-Respondent Nos.1 to 5 submits that if the petitioner seeks to pursue his remedy before the concerned Collector, who is the competent authority to pass order regarding permission for the sale of the land, the petitioner may approach the same, and the concerned Collector may pass an appropriate order in accordance with law. 4. Considering the submissions made by learned counsel for the parties, the present petition is disposed of directing the concerned Collector to consider and decide the said application filed by petitioner, in accordance with law, on the basis of the recommendations made by the concerned Tahsildar as well as the SDO (R), and to pass an appropriate order within a period of 45 days from the date of production of a copy of this order. 5. With aforesaid observation and direction, this writ petition stands disposed of. 6. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
