The petitioner is an accused in connection with Baharagora P.S. Case No.56 of 2025. It has been alleged that the petitioner on the pretext of solemnizing marriage with the daughter of the informant had sexually exploited her and when the victim became pregnant, he had refused to solemnize marriage with her. Submission has been advanced by the learned counsel for the petitioner that the petitioner is in custody since 11.08.2025. It has further been submitted that the petitioner and the victim had agreed to solemnize marriage and in fact the petitioner is also of a tender age. Learned A.P.P has opposed the prayer for bail of the petitioner. The statement of the victim recorded under Section 164 Cr.P.C. reveals about the manner in which the petitioner had enticed the victim and had sexually exploited her. The victim had become pregnant and she had also given birth to a still born child. The petitioner had refused to undergo a DNA test as per the statement of the victim and had also refused to solemnize marriage. The age of victim has been assessed to be 16 years.
