The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.391/2024 registered at Police Station Kanchanpur, District Dholpur for offences under Sections 189(2), 115(2), 126(2), 352 and 351(2) of BNS, 2023. [2026:RJ-JP:25514] (2 of 3) [CRLMB-7237/2026] 2. Since both these bail applications arise out of common FIR, hence, they are being decided by this common order. 3. Heard learned counsels for the petitioners, learned Public Prosecutor as well as learned counsel for the complainant and perused the material available on record. 4. Learned counsel for the petitioner contends that the petitioners have falsely been implicated in these cases. They submit that it is evident from the material available on record that the specific injury inflicted upon the deceased Diwan Thakur has been attributed to the co-accused Mukesh as is apparent from the order passed by the Co-ordinate Bench of this Court dated 04.09.2025. They further submit that there are four injured persons in the case; however, none of the injuries sustained by them has been opined to be dangerous to life, and no medical opinion to that effect is available on record. They contend that co- accused Mahesh, Saurabh, Mukesh Solanki have been granted benefit of bail by Co-ordinate Bench of this Court vide order dated 04.09.2025. The case of the petitioners is akin to them. Petitioners Gaurav and Rahul are behind the bars since 23.07.2025 and 30.07.2025 respectively without any criminal past. The statement of all material witnesses from PW-1 to PW-6 have been recorded. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and on the ground of parity with other co-accused, the bail applications deserves to be allowed. 5. Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail applications of the petitioners. [2026:RJ-JP:25514] (3 of 3) [CRLMB-7237/2026] 6. On consideration of the rival submissions and material available on record and in the light of submissions made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 7. Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Gaurav Singh S/o Mahesh & Rahul S/o Shri Sitto @ Sitaram be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that each of them shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
