The petitioners are apprehending their arrest in connection with Itkhori P.S. Case No.140/2025, registered for the offence under Section 21 of MMDR Act, Rule 4/54 of JMMCR and Rule 13 of JMPIMT and Storage Rules, pending in the Court of the learned A.C.J.M., Chatra. 3. Learned counsel appearing for the petitioners submits that petitioner no.1 is the owner and petitioner no.2 is driver of hywa in question and the allegations are made that 500 cft. stone chips were loaded on the vehicle. He further submits that the said vehicle was hired by another person. He next submits that the petitioners are having no criminal antecedent, as disclosed in paragraph 16 of this application. 4. Learned counsel appearing for the State opposed the prayer and submits that illegally the stone chips were being carried in the said hywa. 5. Considering that petitioner no.1 is the owner and petitioner no.2 is the driver of hywa in question and they have got no criminal antecedent and in that view of the matter, the petitioners are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms, conditions or sureties as the learned Court may deed fit and proper. 6.
