Act, 1985; Md Ansar Ali & Ors. Versus Union of India Mr. Maidul Islam Kayal Mr. Anisur Rahaman Mr. Archishman Singh. …for the petitioners. Mr. Arun Kumar Maiti (Mohanty) Mr. Sagar Saha. …for the NCB. Learned advocate appearing for the petitioners submits that 112 kgs. of ganja were allegedly recovered from the joint possession of the petitioners. Complaint has been filed against five accused persons and the prosecution intends to rely upon 8 witnesses in support of its case. Learned advocate for the NCB, on the other hand, opposes the prayer for bail and submits that as charges have been framed, witness action will commence very soon. Having regard to the quantum of seizure, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted. However, the learned trial court as well as the prosecuting agency 2 would ensure that at least every 1½ months one witness is examined. With the aforesaid observations, CRM(NDPS)580 of 2026 is dismissed. Report submitted by the NCB be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
