ANSHUMAN ORAL ORDER 3 01-04-2026 Heard Learned Counsel for the petitioners and Learned APP for the State. 2. The petitioners are apprehending arrest in a case registered for the offences punishable in connection with Minapur P.S. Case No.460 of 2025 under Sections 192(2), 126(2), 115(2), 303(2) and 109 of the BNS, 2023. 3. As per the prosecution, FIR has been lodged against Patna High Court CR. MISC. No.8129 of 2026(3) dt.01-04-2026 2/3 12 named accused persons including the petitioners with allegation that all persons in connivance with each other have entered in the house of the informant and started abusing. The male accused persons had assaulted by iron rod, lathi-danda whereas the female member had looted Rs.70,000/- and jewellery. 4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He submits that the allegation made against the petitioners are false and fabricated. It has also submitted that both parties are agnates and door-to- door neighbour and due to land dispute, scuffling took place between them. 5. Counsel submits that the criminal antecedent of the petitioner No.5 is clean, petitioner No.1 & 2 have three criminal antecedent, petitioner No.4, 6 and 7 have one criminal antecedent, petitioner No.3 has two criminal antecedent and petitioner No.8 has two criminal antecedent. 6. Learned APP for the State opposes the prayer for bail of the petitioners and submits that petitioners’ antecedent are not clean except petitioner No.5. He further submits that bail application of co-accused persons have been rejected by this Court vide order dated 01.04.2026 passed in Cr. Misc. No.7584 of 2026. 7. In the present facts and circumstances of this case Patna High Court CR. MISC. No.8129 of 2026(3) dt.01-04-2026 3/3 and the submissions made above, let the petitioner No.5 namely, Dolly Kumari, be granted bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Judicial Magistrate, 1st Class, East, Muzaffarpur in connection with Minapur P.S. Case No.460 of 2025, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023. 8. So far as the petitioner Nos.1, 2, 3, 4, 6, 7 & 8, is concerned, this Court is not inclined to grant anticipatory bail to the petitioner Nos.1, 2, 3, 4, 6, 7 & 8, therefore the bail application of the petitioner Nos.1, 2, 3, 4, 6, 7 & 8 is hereby rejected. 9. However, trial court is directed to consider the regular bail application of the petitioner No.4, 6, 7 & 8, who are female, namely, Chandani Kumari, Kanti Devi, Guriya Devi and Pinki Devi, if they surrenders within 4 weeks from today and prays for regular bail, then trial court shall pass order without being prejudice of the present order preferably on the same day.
