Advocate SB: Hon'ble Shri Parth Prateem Sahu, Judge Order on Board 29/04/2026 1. Petitioners have filed this writ petition seeking following reliefs:- “10.1. The Hon'ble Court may kindly be pleased to issue a writ of mandamus 3 directing the respondents to grant the petitioners notional promotion to the post of Upper Division Teacher w.e.f. 29.09.2008 (or at least 20.09.2008) at par with their juniors. 10.2. The Hon'ble Court may kindly be pleased to direct the respondents authority to restore the seniority of the petitioners above their juniors in the cadre of Upper Division Teacher. Lecturer and subsequent promotional cadres. 10.3. The Hon'ble Court may kindly be pleased to direct the respondents authority to revise the seniority list accordingly. 10.4.The Hon'ble Court may kindly be pleased to direct the respondents to consider and grant promotion to the petitioners to the post of Principal from the date their juniors were promoted vide order dated 30.04.2025. 10.5. The Hon'ble Court may kindly be pleased to Grant all consequential benefits including notional pay fixation and service benefits. 10.6.The Hon'ble Court may kindly allow to make a representation and direct the respondent to consider the representation of the petitioners with reference to any policy decision and on the sympathetically. 10.7. Grant any other writ(s), order(s), relief(s) in favour of the petitioners, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioners.” 2. Learned counsel for the petitioners submit that petitioners have not been placed appropriately in the gradation list on account of which petitioners could not have been promoted to the post of Principal though junior to the petitioners have been promoted. He submits that petitioners may be permitted to 4 submit a fresh representation raising all their grievances raised in the writ petition before respondent No.2 and direction be issued to the concerned authority to consider and take decision on the representation(s) at the earliest within a specific time period. 3. Counsel for the respondent-State submits that she has no objection to the limited prayer made by the counsel for the petitioners. 4. On due consideration of the submission of learned counsel for respective parties, without entering in the merits of claim of petitioners this writ petition at this stage is disposed of permitting the petitioners to submit fresh comprehensive representation(s) along with all supporting documents, if any, before respondents No.1 & 2 and in the event, such representation(s) is/are submitted, concerned authorities shall consider and take decision on the same, in accordance with law, expeditiously preferably within a further period of 3 months from the date of receipt of the representation(s). 5.
