1. The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.199/2026 registered at Police Station Itawa, District Kota Rural for offences under Sections 308(2) and 308(7) of BNS, 2023.

2. Since all these bail applications arise out of common FIR, hence, they are being decided by this common order.
3. Heard learned counsels for the petitioners as well as learned Public Prosecutor and perused the material available on record.
4. Learned counsels for the petitioners contend that the petitioners have falsely been implicated in these cases. The allegations levelled against the present petitioners are that they extorted money from the complainant by putting him in fear of the registration of an FIR in relation to alleged sexual offences. It is submitted that no incriminating material or money has been recovered from the possession of the present petitioners. It is further submitted that the complainant entered into an intimate relationship with petitioner Mahi voluntarily of his own free will and with her consent. Petitioners are behind the bars since 22.05.2026 though two cases have been reported against petitioner-Abdul Raees however, in both cases he is already on bail. The matter is exclusively triable by the Magistrate. The investigation/trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, consequently, the bail applications deserves to be allowed.
5. Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail applications of the petitioners.
6. On consideration of the rival submissions and material available on record and in the light of submissions made by
learned counsel for the petitioners but without expressing any
[2026:RJ-JP:25333] (3 of 3) [CRLMB-9534/2026] opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
7. Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Abdul Raees S/o Abdul Rashid & Smt. Mahi @ Majhabi @ Mahjabi W/o Mohammad Jafar D/o Mohammad Yunus be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that each of them shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
