Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 30/04/2026 1. By way of this petition, the petitioner has prayed for following reliefs:- “1. That, the Hon'ble Court may be pleased to issue a writ, order of direction or any other appropriate writ direction to Respondent No. 3 to expeditiously decide the petitioner's application for permission to sell the rehabilitation land (Annexure P/2) dated 29.10.2020 bearing Proceeding No. 202011020700078 of 2020-21, Class B121 pending since 2020-21 in expedited manner in outer limit of 15 day looking to the medical condition of the Petitioner No.1 need of funds. 2. Any other relief, which this Hon'ble Court deems fit in the facts and circumstances, may also be granted in favour of the petitioner.” 2. Brief facts of the case are that the instant petition has been preferred seeking a direction to respondent No. 3 to decide the petitioners’ application for grant of permission to sell rehabilitation land under Section 165(7-B) of the Chhattisgarh Land Revenue Code, 1959 (henceforth referred to as “the Code, 1959”), pertaining to Revenue Proceeding No. 202011020700078 of 3 2020-21, Class B-121, which, despite completion of all requisite legal formalities and submission of reports during the year 2020- 2021, has remained pending since 2020 without any justifiable reason. In view of the urgent financial requirement of the petitioners, particularly for meeting expenses relating to health disease of petitioner No.1, it is prayed that the said application be directed to be decided expeditiously within an outer limit of 15 days. Hence, this petition. 3. Learned counsel for the petitioners submits that the petitioners had filed an application under Section 165(7-B) of the Code, 1959 before the concerned Collector on 29.10.2020; however, despite the lapse of a considerable period, the said application has not yet been decided, even though proceedings in respect thereof have already been initiated by the competent authority. 4. Learned counsel appearing for the State-Respondents submits that the State has no objection if an appropriate direction is issued to the concerned Collector to consider and decide the petitioners’ application expeditiously, in accordance with law. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, and further taking into account that the application in question was filed way back on 29.10.2020 and has remained pending since then, it is deemed appropriate to direct the concerned Collector, Ambikapur, District Surguja, to consider and decide the said application strictly 4 in accordance with law, within a period of 60 days from the date of receipt of a copy of this order. 7. With aforesaid observation and direction, the writ petition stands disposed of. 8. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
