[2026:RJ-JP:25376] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 9630/2026 URN: CRLMB / 17861U / 2026 Barkat Mohammad S/o Shri Mehtab, Aged About 41 Years, R/o Village Raghunathgarh, Police Station Dadiya, District Sikar (Rajasthan) (At Present Confined In District Jail, Sikar, District Sikar). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Vikash Meena Mr. Murad Baig Ms. Shefaly Srivastava Mr. Devang Jharwal For Respondent(s) : Ms. Manju Dave, PP Mr. Dhanraj Bhaskar HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 07/07/2026 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.362/2025 registered at Police Station Dadiya, District Sikar for offences under Sections 318(4), 316(2) and 351(2) of BNS 2023. 2. Heard learned counsel for the petitioner, learned Public Prosecutor as well as learned counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He submits that the complainant Vikas had executed a sale deed with the original owner Shamim Bano; however, when the said agreement was not acted upon the petitioner was falsely implicated in the present case on the basis of false and concocted allegations. It is [2026:RJ-JP:25376] (2 of 2) [CRLMB-9630/2026] contended that the petitioner himself is, in fact, the victim in the present matter as the original owner, Shamim Bano, had already sold the said land to the petitioner on 28.12.2024, prior to the execution of the sale deed in favour of the complainant. It is further averred that the petitioner neither induced the complainant nor derived any wrongful benefit from the alleged transaction. Petitioner is behind the bars since 10.06.2026 without any criminal past. The matter is exclusively triable by the Magistrate. The investigation/trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in light of submission made on behalf of petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Barkat Mohammad S/o Shri Mehtab, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
