Hon'ble Shri Ramesh Sinha, Chief Justice Hon'ble Shri Ravindra Kumar Agrawal, Judge Judgment on Board 4 Per Ramesh Sinha , Chief Justice 01/05/2026 1 Though four advocates have filed their Vakalatnama on behalf of the appellants, none has appeared to press this appeal, which is also barred by a delay of 39 days. However, I.A. No. 01/2026 has been filed for condonation of delay. Considering that a similarly situated writ appeal, i.e., WA No. 193/2026, involving a similar issue, has already been considered and decided by this Court vide judgment dated 13.03.2026 passed in WA No. 193/2026 (Pushpalata Manikpuri and Others v. State of Chhattisgarh and Others), and further considering the reasons mentioned in the application (I.A. No. 01/2026), the same is allowed. The delay of 39 days in filing the present writ appeal is hereby condoned, and the appeal is heard finally. 2 The present writ appeal is directed against the order dated 24.11.2025 passed by the learned Single Judge of this Court in WPS No. 9014/2025, whereby the writ petition filed by the petitioners was dismissed. 3 Learned Deputy Advocate General appearing for the respondent- State submits that the issue involved in this writ appeal has already been considered and decided by this Court vide judgment dated 13.03.2026 passed in WA No. 193/2026, wherein this Court held as under: “33. Upon perusal of the impugned order, we find that the same has been rendered by the learned Single Judge with cogent and justifiable reasons. In an intra-court 5 appeal, no interference is ordinarily warranted unless palpable infirmities are noticed. The learned Single Judge, while dismissing the writ petition by the impugned order, has considered all the facts of the case. We do not find any fault in the impugned order. 34. In view of the above, the writ appellants/petitioners have failed to demonstrate that they are similarly situated to the petitioner in Writ Appeal No. 261/2023 (Smt. Sona Sahu v. State of Chhattisgarh and Others). Their claim under the Circular dated 10.03.2017 is, therefore, misconceived, and the learned Single Judge has rightly dismissed the writ petition. Accordingly, the present writ appeal is devoid of merit and is hereby dismissed.” 4 In view of the above, the present writ appeal is also dismissed in terms of the judgment dated 13.03.2026 passed by this Court in WA No. 193/2026.
