Virender Singh, Judge (Oral) By way of present applications, a prayer has been made by the petitioner-husband Ankur Chawla, to transfer the cases bearing Case No. 860/2021, titled as “Ankur Chawla Versus Sonia Chawla”, pending before the learned District & Sessions Judge, Family Court, Solan, District Solan, H.P. and case bearing No. 63/2021, titled as “Sonia Thakur Versus Ankur Chawla”, pending before 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 2026:HHC:18695 the learned Chief Judicial Magistrate, Solan, District Solan, H.P. 2. The transfer of the case has been sought, mainly on the ground that the petitioner has undergone the heart-surgery and as such, he could not attend the proceedings at Solan. 3. According to him, he is residing at Dehradun and it is very difficult for him to attend those proceedings. 4. Although, reply to the application has not been filed, but prayer has been opposed. 5. The Hon’ble Supreme Court, while deciding Transfer Petition bearing No. 2923 of 2022, has transferred the case titled as “Ankur Chawla Versus Sonia Chawla”, pending before the court of learned Principal Judge, Family Court, Dehradun, Uttarakhand, to the learned District Court (Family Court), Solan, H.P. 6. This order has been passed on 16.01.2023. The learned counsel appearing for the petitioner, could not satisfy the judicial conscience of this Court, as how the present application is maintainable after the order having been passed by the Hon’ble Supreme Court on 16.01.2023, in Transfer Petition (Civil) No. 2923 of 2022, titled as 3 2026:HHC:18695 “Sonia Thakur Versus Ankur Chawla”. When the case has been transferred from the court of learned Principal Judge, Family Court, Dehradun, Uttarakhand, to the learned District Court (Family Court), Solan, H.P., then, the prayer, so made in the applications, is not liable to be considered. 7.
