Affidavit of service filed by the petitioner is taken on record. None appears for the respondents despite service. The petitioner participated in a tender floated by the Block Development Officer, Sagar, being the 4th respondent herein on 29th September, 2020 for construction of a concrete road from Radhakrishnapur High School to Bahirplot concrete jetty. Being the lowest bidder, the work order was issued in favour of the petitioner on 15th October, 2020. The petitioner completed the work within the stipulated period of time, that is, by 11th November, 2020 and bills raised by him were approved by the Nirman Sahayak of the concerned Gram Panchayat. Out of the entire amount of Rs.15,43,704/- an amount of Rs. 7,60,000/- was paid to the petitioner. The remaining amount of Rs.7,83,704/- is still due. The petitioner submitted a representation before the concerned authority in this regard on 7th December, 2023 which is yet to be considered. The petitioner seeks disbursal of the due amount.
2 Upon consideration of the submission made on behalf of the petitioner, the Block Development Officer, Sagar, being the 4th respondent herein is directed to consider and dispose of the representation submitted by the petitioner dated 7th December, 2023 within six weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The said authority shall disburse the remaining amount in favour of the petitioner upon verification of the documents submitted by him and upon compliance of all requisite formalities in this regard within one month thereafter. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
