PUBLIC PROSECUTOR The Court made the following: 2 ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.83 of 2024 of Gangavaram Police Station, Alluri Sitharama Raju District, for the alleged offences punishable under Sections 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’) and Sections 111(2)(b) of the Bharatiya Nyaya Sanhita, 2023 (for brevity, ‘the BNS’). 2. Heard the learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. On perusal of the record, the allegation against the Petitioner is that he was found in possession and transportation of 187 kilograms of ganja. The present bail application is the second one filed by the Petitioner. This Court, in Crl.P.No.4962 of 2026, vide order dated 30.06.2026, dismissed the first bail application filed by the Petitioner with detailed reasons. There is no change in circumstances from the date of dismissal of the first bail application till the date of filing of the present bail application. With regard to the other accused, charge sheet has been filed, but insofar as the Petitioner is concerned, the charge sheet has not yet been filed. 3 4. Having regard to the entire facts and circumstances of the case, the nature and gravity of the allegations levelled against the Petitioner/Accused No.1, who is alleged to have been involved in dealing with 187 kilograms of ganja, and in view of the fact that there is no change in circumstances from the date of dismissal of the first bail application till the filing of the present (second) bail application, this Court is not inclined to enlarge the Petitioner/Accused No.1 on bail at this stage. 5. 5.
