This application has been filed under section 483 of the Bharatiya Page No.# 2/3 Nagarik Suraskha Sanhita, 2023, whereby the accused petitioners namely, (i) Bishu Rongpi (ii) Rangsina Ronghang (iii) Munu Rongpi, have prayed for bail in connection with Basistha P.S. Case No. 223/2026 under Section 303(2)/325 of BNS, 2023 r/w Section 11(1)(a)/11(1)(d) of Prevention of Cruelty to Animals Act, 1960. 3. The petitioners were arrested on 28.06.2026. 4. Case diary is not received today. However, the learned counsel for the petitioner prays for interim bail at this stage. 5. A written intimation has been placed before the Court by the prosecution which is sent by the I/O, seeking another date to produce the case diary. 6. An FIR was lodged by the informant, claiming to be an animal rights activist, stated that he was looking after some community dogs in the area, but found them disappearing. In the CCTV footage, he found one vehicle, trying to pick up dogs, but he could not identify the registration number of the vehicle. No persons have been named as accused in the FIR. 7. The present petitioners were arrested during the investigation and the forwarding report stated that one Hyundai Grand i10 bearing Regd. No. AS-09-K-3453 is the vehicle in question, mentioned by the informant. As noted earlier, the petitioners are not named in the FIR. The forwarding report and the grounds of evidence also do not mention about any recovery of any animals/dogs from their possession. 8. In the circumstances, while the case diary may be looked at, the Page No.# 3/3 under trial detention of the accused persons can be put on hold for the moment. Therefore, in such a situation, I am of the considered view that as the petitioners can be allowed to go on interim bail. 9. Accordingly, in the interim, it is directed that, the accused- petitioners, named above, shall be released on interim bail in connection with Basistha P.S. Case No. 223/2026 under Section 303(2)/325 of BNS, 2023 r/w Section 11(1)(a)/11(1)(d) of Prevention of Cruelty to Animals Act, 1960, on furnishing bail bond of Rs.20,000/- each with one suitable surety each of the like amount to the satisfaction of learned concerned court [CJM, Kamrup(M)] 10. The direction for bail is further subject to the following conditions: (a) That the petitioners shall co-operate remaining investigation; and (b) That the petitioners shall not hamper or tamper with evidence. 11.
