Affidavit of service filed on behalf of the petitioner is taken on record. 2. Matter is heard in presence of the learned advocates representing the petitioner, State respondents and respondent no. 13. 3. Mr. Sabyasachi Chatterjee, learned advocate representing the petitioner appears on virtual mode and submits that concerned police authority is not returning two mobile sets of the petitioner which were forcibly taken from the petitioner without preparing seizure list. 4. Such submission made on behalf of the petitioner is opposed by Mr. Jayak Gupta, 2 learned advocate representing State respondents. It is specifically submitted that mobile sets of the petitioner were not taken forcibly. It is also submitted that no mobile sets of the petitioner were seized by the police authorities in connection with Udaynarayanpur P.S. Case No. 122 of 2025 dated 13th September, 2025. 5. During course of hearing it is found that petitioner filed another writ petition being WPA 1555 of 2026 in connection with Udaynarayanpur P.S. Case No. 122 of 2025 dated 13th September, 2025. Though that writ petition was filed in 2026 whereas as per submission made on behalf of the petitioner two mobile sets were purchased in October, 2025. Issue relating to return of mobile sets by the police authorities was not raised in the previous writ petition. Said writ petition being WPA 1555 of 2026 is still pending. A coordinate bench on 2nd February, 2026 directed the parties to exchange affidavits. 6. During course of hearing Mr. Chatterjee, learned advocate representing the petitioner submits leave may be granted to file an application in connection with pending writ petition being WPA 1555 of 2026. 3 7. In view of such submission made on behalf of the petitioner writ petition stands disposed of thereby granting leave to the petitioner to file an appropriate application in connection with WPA 1555 of 2026. 8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
