1. By the present petition, the Petitioner seeks the relief of quashing the departmental proceedings initiated by Respondent No.4 against the Petitioner.
2. The learned counsel appearing for the Petitioner submits that the Petitioner was appointed as an ‘Assistant Teacher’ in the year 2001 and has been functioning as a Headmaster since the year 2006. He submits that due to inter se dispute between the rival sections of the trust, the Petitioner is being targeted and recently show-cause notices and statement of allegations are being issued to the Petitioner, only with the purpose of terminating the services of the Petitioner. He submits that as the proceedings are mala ide, the same are required to be quashed. Gaikwad RD 1 of

3. The relief as sought in the present petition is to quash and set aside the departmental proceedings. Considering that the departmental enquiry has been initiated, this Court is not inclined to quash the departmental proceedings by going into the issue of mala ides. However, as the Petitioner is working as Headmaster since the year 2006, in event, any adverse order is passed against the Petitioner in the departmental enquiry, the same not be implemented for a period of two weeks from the date of the order, in order to enable the Petitioner to approach the Tribunal.
