JUSTICE R.K. PATTANAIK Order No. ORDER 17.02.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Borigumma P.S. Case No.6 of 2026 corresponding to G.R. Case No.6 of 2026 pending in the court of learned J.M.F.C., Borigumma on the grounds stated. 3. Perused the FIR as at Annexure-1. Learned counsel for the petitioners submits that the co-accused persons are on bail and while claiming so, produced a copy of the orders dated 12th January, 2026 and 13th January, 2026 of the learned JMFC, Borigumma. The further submission is that the stolen articles have been seized by the police during investigation and while stating so, he also produces a copy of the seizure memo dated 8th January, 2026. The FIR is lodged as per Annexure-1 on the theft of TMT MM rod and iron plates. The seizure memo reveals that one quintal TMT rod and four iron plates each of 70 Kgs. have been seized by the police. The co-accused persons are on bail by the orders of the learned court below as revealed from the copies of the orders produced at the time of hearing and considering the same and objection of the State and the claim that the petitioners are not having any antecedents, this Court though not inclined to grant them pre-arrest bail but is of the view that they should be directed to surrender before the learned court below for being released with suitable conditions imposed. 4. Hence, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioners to surrender before learned J.M.F.C., Borigumma within a fortnight from today and in the event of their surrender in compliance thereof, they shall be released on bail in connection with G.R. Case No.6 of 2026 on furnishing bail bonds of Rs.40,000/- (rupees forty thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, they shall attend the PS once in a fortnight for the purpose of investigation and to continue to do so, till its completion. The above order shall not be given effect to, as is further directed, if upon verification, the learned court below finds any of them having similar past antecedents. 6.
