The petitioners are apprehending their arrest in connection with Complaint Case No.31689 of 2025, for offence registered under section 4 and 21 of Mines and Mineral (Development and Regulation) Act, 1957, Rule 54 of Jharkhand Minor Mineral Concession Rules, 2004, Rules 9 and 11 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned Additional Chief Judicial Magistrate at Ranchi.

Learned counsel for the petitioners submits that the petitioner no.1 is the owner and petitioner no.2 is the driver of Hywa Truck and allegations are made of carrying 100 cft sand on the said Hywa truck. He further submits that identical allegations

are made against other vehicles and owner and driver of Tata Tiper Hywa and owner and driver of another Tata Tiper Hywa has been granted anticipatory bail in ABA No.6915 of 2025 and ABA No.7043 of 2025.
4. Learned State counsel opposes prayer and submits that illegally the sand in question was being carried.
5. Considering that in identical situation the other owner cum drivers of other vehicles have been granted anticipatory bail and the petitioners happened to be owner and driver respectively and in that view of that matter, both the petitioners, above named, are
directed to surrender before learned court within two weeks from today and learned court shall release petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
6. This petition being A.B.A. No.936 of 2026 is disposed of.
