The present application has been filed by the petitioner praying for impleadment of Shri. Mohammed Ali Shihab, IAS, Commissioner & Secretary, Department of P &AR Nagaland as respondent/contemnor No.4 and Er. Swarai Meru, Engineer-in-Chief, NPWD as respondent No.5 in COP(C) 14/2023 which is pending disposal before this Court. Heard the learned counsel for the petitioner Mr. Limawapang. It is submitted by the learned counsel for the petitioner that during pendency of COP(C) 14/2023, the erstwhile respondent Nos. 2 and 3 has already been transferred out from the concerned Department and new incumbents as mentioned herein above have taken charge as Commissioner & Secretary, Department of P &AR Nagaland and Engineer-in-Chief, NPWD thereafter. The learned counsel therefore submits that in the facts and circumstances, the new incumbents needs to be impleded for proper adjudication of the case. In view of the pleadings made herein above, this application is allowed and the petitioner/applicant is allowed to implead the above mentioned new incumbents as respondent
Page No.# 3/3 Nos. 4 and 5 in COP(C) 14/2023 which is pending before this Court. The applicant/petitioner shall make necessary corrections in the cause title and file amended cause title within a period of one week from today and thereafter take steps for service on the newly impleaded respondents by speed post. I.A. stands disposed of.
