PUBLIC PROSECUTOR The Court made the following: 2 ORDER: The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to set aside the order dated 18.08.2026 passed in Crl.M.P.No.667 of 2026 on the file of the learned II Additional District and Sessions Judge, Kadapa at Proddatur, and consequently extend the time by 30 days for the Petitioner to surrender before the learned I Additional Judicial Magistrate of First Class, Proddatur in connection with Cr.No.113 of 2026 on the file of I Town Police Station, Proddatur. 2. Heard learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. The prosecution case is that, on 02.06.2026, the Respondent Police, upon receiving information regarding alleged illegal cricket betting as an organized crime, proceeded to the spot and arrested Accused Nos.1 to 6. During investigation, relying on the alleged confession of co-accused, the Petitioner was implicated as Accused No.8 along with others. 4. On perusal of the record, the Petitioner approached the learned II Additional District and Sessions Judge, Kadapa at Proddatur by filing an application in Crl.M.P.No.667 of 2026 seeking anticipatory bail in connection with Cr.No.113 of 2026 on the file of I Town Police Station, Proddatur. The 3 learned Sessions Court allowed the application by order dated 08.07.2026, subject to the following conditions: “In the result this anticipatory bail application is allowed by directing the petitioner/ accused No.8 to surrender himself before the concerned I Additional Judicial Magistrate of I Class Court, Proddatur within 15 days from today and on such surrender, the concerned court is directed to release him on bail upon him execution of perusal bond for Rs.20,000/- each with two sureties for like sum each to the satisfaction of the I Additional Judicial Magistrate of I Class Court, Proddatur. Further, the petitioner/accused No.8 is directed to appear before the investigation officer on every Sunday at any time in between 10:00 am to 5:00 pm for a period of two months (or) till filing of the charge sheet whichever is earlier.” 5. The learned counsel for the Petitioner submits that the Petitioner could not comply with the surrender condition as his father suddenly fell ill. Being the only son, the Petitioner had to accompany his father to Kurnool for medical treatment. Hence, the failure to appear was neither wilful nor deliberate. 6. The Petitioner thereafter filed Crl.M.P.No.728 of 2026 before the Sessions Court seeking extension of 30 days’ time to surrender. The learned Sessions Judge dismissed the application by order dated 18.08.2026. 7. Having regard to the facts and circumstances of the case, the Petitioner is permitted to surrender before the I Additional Judicial Magistrate of First Class, Proddatur within one (01) week from the date of receipt of a copy of this order. No further time shall be granted. 8. In the result, the Criminal Petition is disposed of. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
