By way of this bail application, the petitioner prays for grant of regular bail in connection with Chainpur Police Station Case No.03 of 2025, registered for offences alleged under Sections 190, 191(2), 191(3), 332(a), 109, 103(1), 61(2), 111(2)(b) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act, pending in the Court of the Sub Divisional Judicial Magistrate, Palamau at Daltonganj. 3. First Information Report being Chainpur Police Station Case No.03 of 2025 was registered on the basis of written report of the informant. It has been alleged that son of the informant namely, Bharat Pandey @ Bharat Singh had gone to Village Garda, Police Station Chainpur to his Uncle (Mousa) Kamresh Singh’s house for attending his grand son’s (son of Sanyog Singh) birthday party. On 06.01.2025 at about 12.30 p.m. Sanyog Singh informed the informant over phone that some miscreants through indiscriminate firing have killed informant’s son. On coming to the place of occurrence, informant gathered that his son and his friend Deepak Sao @ Dhulla were killed through firing by the miscreants and two others, namely, Anshu Singh and Bablu Singh were injured. It has been alleged by the informant that his son had been released from jail about 8 months ago and since after his release, he was being threatened of being killed by Nishi Pandey at the instance of Vikash Tiwary who was instigating from jail. Informant has claimed that Vikash Tiwary in conspiracy with Nishi Pandey in association with other members of his gang, namely, Akash Tiwary, Vikash Sao, Amit Sao, Subhash Singh @ Bagha Singh, Anil Yadav, Sunil Dhobi, Babloo Thakur, Sandeep Thakur, Nishant Singh has executed the crime. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the 2026:JHHC:8921 -: 2 :- informant has only mentioned the name of the petitioner along with others to be associates of the gang of Vikash Tiwary and save and except the same, no overt act has been alleged against the petitioner. He submits that even in course of investigation also nothing has transpired so as to connect the petitioner to the alleged crime. 5. Learned A.P.P. appearing for the State vehemently opposes the prayer for bail of the petitioner. 6. I have gone through the impugned order, the First Information Report as also the Case Diary. As per the First Information Report, it has been alleged that some persons indiscriminately fired due to which informant’s son and his friend Deepak Sao died and two others were injured. In course of investigation, statements of two injured persons, namely, Anshu Singh and Babloo Singh were recorded by the police at paragraphs 29 and 30 of the case diary. These two injured persons have also not stated names of any miscreants, rather have stated that 8-9 persons, armed with fire arms, were firing indiscriminately. The petitioner and other persons have been made accused in this case, merely on suspicion that they belong to the gang of Vikash Tiwary at whose instigation, Nishi Pandey was repeatedly threatening the son of the informant that he would be killed. 7. Considering the above facts and circumstances of the case, I am inclined to grant bail to the petitioner. Petitioner, namely, Amit Kumar Sao @ Amit Kumar Saw, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Palamau at Daltonganj in connection with Chainpur Police Station Case No.03 of 2025, subject to the condition that one of the bailers should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand.
