JUSTICE YARENJUNGLA LONGKUMER ORDER Date : 16-07-2026 The instant application has been filed by the Respondent Nos. 1 to 3 in COP(C)/30/2026 with a prayer for keeping the proceedings of the connected COP(C)/30/2026 in abeyance till the disposal of WA/28/2026 pending before the Division Bench of this Court. 2. Heard learned Senior Counsel, Mr. P.J. Saikia, assisted by learned counsel, Mr. Moa Jamir, appearing for the Applicants/Respondents. Also heard Ms. Rovimeno Thou, appearing for the Respondent/Petitioner. 3. The submission of the learned Senior Counsel is that, against the judgment and order dated 20.01.2026 passed in WP(C)/94/2022, the Applicants herein have preferred a writ appeal, which is registered as WA/28/2026. The writ appeal is accompanied by I.A.(Civil)/134/2026 seeking condonation of a delay of 120 days in filing the connected writ appeal. By order dated 24.06.2026 in I.A.(Civil)/134/2026, the Division bench issued notice, and the matter is listed on 12.08.2026. The learned Senior Counsel, therefore, prays that the connected COP(C)/30/2026 may be kept pending till the writ appeal as well as the connected I.A. (Civil)/134/2026 and I.A.(Civil)/135/2026 are disposed of, as the Page No.# 4/4 Applicants have taken good grounds and there is every likelihood of success in both the interlocutory applications as well as the writ appeal. 4. The learned counsel for the Respondent/Petitioner, Ms. Rovimeno Thou, has objected to the prayer made by the Applicants herein on the ground that there is no stay order in as far as the judgment and order dated 20.01.2026 passed in WP(C)/94/2022 is concerned and that I.A. (Civil)/134/2026 praying for condonation of delay has not yet been allowed by the Division Benc. Accordingly, she prays that the instant application may be kept pending till the I.A.(Civil)/134/2026 is disposed of. 5. This Court has considered the submissions of the learned Senior Counsel for the Applicants as well as the learned counsel for the Respondent/Petitioner. It is the view of this Court that in the event the delay is condoned and the writ appeal is allowed, irreparable loss would be caused to the Applicants herein and, therefore, it is appropriate that the COP(C)/30/2026 be kept pending till the disposal of WA/28/2026. 6. Accordingly, the instant application is allowed, and the proceedings in COP(C)/30/2026 shall remain in abeyance till the disposal of WA/28/2026. JUDGE Comparing Assistant
