For Petitioner : Mr.M.Ponniah For Respondents : Mr.B.Ramanathan, (for R1 & R2) Additional Government Pleader Mr.T.Venkatesan (for R3 & R4) O R D E R This Writ Petition is filed directing the second respondent to survey and fix the four boundaries of the petitioner's property comprised in S.No.111/6E1B1, situated at Vandiyur-II Bit Village, Madurai East Taluk, Madurai District, on the basis of the petitioner's application for survey dated 11.01.2024 and 27.03.2024. 2. Since no adverse orders are going to be passed against the fifth respondent, notice to the fifth respondent is hereby dispensed with. 4. The learned counsel for the petitioner would submit that the property is an ancestral in nature. With a view to properly identify the boundaries and avoid future disputes, the petitioner submitted an application for survey dated 11.01.2024 and 27.03.2024 before the competent revenue authorities seeking survey the land and fix the four boundaries of the subject property. Despite the said application, the official respondents have failed to take any action to survey the land and fix the four boundaries of the petitioner’s land within a reasonable time. Hence, the petitioner has been constrained to approach this Court by filing the present Writ Petition. 5. The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that proper steps would be taken to survey the land and fix the four boundaries in accordance with the law. 6. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of 3/6 https://www.mhc.tn.gov.in/judis W.P.(MD) No.29036 of 2025 with a direction to the respondents 1 and 2 to consider the petitioner's application dated 11.01.2024 and 27.03.2024, on merits and in accordance with law and pass appropriate orders within a period of twelve (12) weeks from the date of receipt of a copy of this order. The application shall be considered and disposed of after conducting an enquiry. The respondents 1 and 2 are directed to provide reasonable opportunity during such enquiry to the petitioner, respondents 3 to 5 and also to the other persons, who may be affected by such decision. It is needless to state that the revenue officials may seek assistance from the Police, if Police assistance is required while carrying out such survey. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs.
