Kausik (Allowed) CRM (M) 492 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Galsi Police Station Case No. 456 of 2019 dated 06.11.2019 under sections 436/326/307/34 and adding Section 302 of the Indian Penal Code, 1860. And In the matter of : Sk Yusuf ……Petitioner. Mr. Uday Sankar Chattopadhyay Ms. Sadia Parveen ……for the Petitioner. Mr. Bibhaswan Bhattacharyya Ms. Manasi Roy ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody since 06.11.2019 which is more than 6 years 5 months. Till date, out of 19 witnesses cited by the prosecution in the charge sheet, 11 witnesses have been examined and pursuant to the directions passed in CRM 8531 of 2020, another accused namely Ekram Sk. was subsequently granted bail in the year 2024. Learned advocate for the State was questioned regarding the locus of the present petitioner and Ekram Sk. according to the State from the statement of the victim under section 164 of Cr.P.C., the petitioner and Ekram Sk. is similarly situated. 2 Having considered the period of detention and without entering into the merits of the case, I am inclined, as such to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Sk Yusuf shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional Sessions Judge, 3rd Court, Purba Bardhaman. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Purba Bardhaman without the prior permission of the Learned Trial Court. Thus, CRM (M) 492 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
