JUSTICE R.K. PATTANAIK Order No. ORDER 12.02.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with P.R. No.71 of 2024-25 corresponding to 2(a) C.C. Case No.72 of 2024 pending in the court of learned J.M.F.C.(City), Cuttack on the grounds stated. 3. Perused the PR as at Annexure-1. The petitioner apprehends arrest since his vehicle has been seized in connection with the case, which was used by the accused named therein in the transportation of the I.D. Liquor. The P.R. reveals that 60 liters of I.D. liquor was being transported at the relevant point of time. Considering the fact that the petitioner is the owner of the vehicle in question, recording the objection of the State, this Court is of the view that he should be directed to surrender before the learned court below and released on bail with suitable conditions imposed instead of granting him pre- arrest bail as has been demanded. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned J.M.F.C.(City), Cuttack within a fortnight from today and in the event, he surrenders in compliance thereof, shall be released on bail in connection with 2(a) C.C. Case No.72 of 2024 on furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with one solvent surety for the like amount to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall report the I.O and extend cooperation to him in the investigation, which is stated to be currently in progress and to furnish an undertaking to the effect that his vehicle shall not be utilized for any such illegal purpose in future. 6.
