For Petitioner : Ms.R.Karthika For R1 to R3 : Mr.N.Ramesh Arumugam Government Advocate ORDER This writ petition has been filed seeking issuance of a Writ of Mandamus, directing the third respondent to issue a separate patta in respect of the petitioner’s property in S.F.No.148/8G4, measuring an extent of 0.04.76 ares out of the total extent of 0.09.52 ares, situated at Kothamangalam South Village, Alangudi Taluk, Pudukkottai District, in the petitioner’s name, by considering the petitioner’s representation dated 10.07.2025, within a time frame to be stipulated by this Court. 2. Heard the learned counsel appearing for the parties. 3. According to the petitioner, he is the absolute owner and in peaceful possession of the subject property in S.F.No.148/8G4, measuring an extent of ____________ p. 3 W.P.(MD)No.28273 of 2025 0.04.76 ares, situated at Kothamangalam South Village, Alangudi Taluk, Pudukkottai District. The said property is ancestral in nature, having devolved upon the petitioner through lawful succession, and the petitioner has been enjoying the same without any dispute or rival claim. Though the total extent in the survey field is 0.09.52 ares, the petitioner is entitled to a separate patta for his specific and demarcated share, as recognized under revenue law. Hence, the petitioner submitted a representation dated 10.07.2025 to the third respondent seeking issuance of a separate patta; however, the same has not been considered till date. Hence, the present Writ Petition. 4. The learned Government Advocate appearing for the respondents 1 to 3 submits that the petitioner's representation will be considered on merits and in accordance with law. 5. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 10.07.2025, on merits and in accordance with law and pass appropriate orders after providing ____________ p. 4 W.P.(MD)No.28273 of 2025 reasonable opportunity of hearing to the petitioner, the respondents 4 to 6 and also to the other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order.
