Learned advocate appearing for the petitioner submits that the petitioner has been implicated on the basis of the statement of co-accused and the subject matter of the case relates to alleged recovery of 1,000 bottles of phensedyl although the same is not recovered from the petitioner. Learned advocate for the State, on the other hand, submits that charge-sheet has been submitted, some of the accused persons are absconding and so far as the present petitioner is concerned, there are criminal antecedents or similar offences wherein there was alleged recovery from the present petitioner. Be that as it may, the petitioner is in custody for about five months. Having considered that there was no recovery from the 2 present petitioner so far as the instant case is concerned, I am of the opinion that further detention of the petitioner may not be unwarranted in the facts and circumstances of the present case. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Tiku Sk. @ Tinku Sk. shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional District Judge, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date fixed by the learned special court and shall not leave the district of Malda without prior permission of the learned special court. Accordingly, CRM(NDPS) 607 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
