SANJEEV PRAKASH SHARMA Order 03/07/2026 1. Both the parties have submitted in their submissions that there is a dispute which has arisen between them. While the petitioner alleges short payment, the respondent stated that excess payment has already been made. 2. This court notes that there is an arbitration clause in the agreement, i.e., Clause No.31, which reads as under:- “Any dispute or differences arising between the parties shall be referred to arbitration as per the provisions of The Arbitration And Conciliation Act (Amendment), 2020 referred to the Sole Arbitrator appointed by mutual consent of both the parties or if the parties fails to appoint arbitrator mutually, both the parties shall appoint two arbitrators.each. The arbitrators shall appoint a third arbitrator. The arbitrators shall decide the dispute within two [2026:RJ-JP:24899] (2 of 2) [ARBAP-34/2024] months. The award passed by the arbitrator as the case be shall be final. Conclusive and binding on both the parties.” 4. Both the learned counsels for the parties have agreed to appoint Hon'ble Mr. Justice V.S. Siradhana, Former Judge, Rajasthan High Court, R/o 715-C, Mahaveer Nagar Ist, Durgapura, Jaipur as the Sole Arbitrator to resolve the dispute between the parties. 5. Accordingly, with the consent of the parties, this Court directs appointment of Hon'ble Mr. Justice V.S. Siradhana, Former Judge, Rajasthan High Court, R/o 715-C, Mahaveer Nagar Ist, Durgapura, Jaipur to act as the Sole Arbitrator and to decide all issues without prejudice to the rights and contentions raised in the present application proceedings. The arbitration fees shall be determined in accordance with the Fourth Schedule of the Act of 1996, as amended. The fee of the Arbitrator will be equally borne by both the parties. 6. The Arbitrator is requested to complete the proceedings as per the time limit specified under Section 29A of the Act of 1996. 7. The arbitration application is allowed accordingly. 8.
