By means of the present application, the applicant seeks grant of anticipatory bail in connection with FIR dated 14.10.2023, being FIR No. 726 of 2023, registered at Police Station Bhagwanpur, District Haridwar, for the offences punishable under Sections 3, 5 and 11 of the Uttarakhand Protection of Cow Progeny Act, 2007. 3. The Coordinate Bench of this Court, vide order dated 09.11.2023, granted interim anticipatory bail to the applicant. In compliance with the conditions stipulated therein, the applicant has duly cooperated with the investigation as and when called upon by the Investigating Officer. 4. Learned counsel for the applicant submits that the charge-sheet has already been filed, the trial is pending, and the applicant has been regularly cooperating with the proceedings. 5. Learned counsel for the applicant further submits that, pursuant to the interim protection granted by this Court, the applicant has cooperated throughout the course of investigation and has not misused the liberty so granted to him. It UKHC010182772023 2026:UHC:7413 is further submitted that, in view of the filing of the charge-sheet, no custodial interrogation of the applicant is required at this stage. 6. Having heard learned counsel for the parties and upon perusal of the material available on record, this Court finds that the applicant has remained protected by virtue of the interim order dated 09.11.2023 and has duly complied with the conditions stipulated therein. The applicant has extended full cooperation during the course of investigation, and no material has been placed before this Court to indicate that he has either misused the liberty granted to him or failed to cooperate with the investigating agency. 7. Having regard to the facts and circumstances of the case, particularly the conduct of the applicant during the period of interim protection, and without expressing any opinion on the merits of the case, this Court is of the considered opinion that the applicant has made out a case for confirmation of the interim anticipatory bail granted vide order dated 09.11.2023. 8. Consequently, the interim anticipatory bail granted to the applicant vide order dated 09.11.2023 is hereby confirmed and made absolute. The applicant shall remain on anticipatory bail on the same terms and conditions as contained in the aforesaid order. 9. Accordingly, the present Anticipatory Bail Application stands allowed.
