1.PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’), by the Petitioner/Accused No.2 seeking anticipatory bail in connection with Crime No.185 of 2023 of Kadiri Town Police Station, Sri Satya Sai District, registered for the alleged offences punishable under Sections 307, 324 read with 34 of the Indian Penal Code, 1860 (for short ‘the I.P.C.’). 2

Case of the prosecution is that on 26.06.2023 at 11.00 P.M. at Rahamthulla Hotel, Bilal Nagar, Kadiri Town, the accused Nos.1 to 3 picked up quarrel with the defacto complainant and beat him with hands and legs and cut his throat and caused severe bleeding injuries. Hence, the crime. 3. Heard Sri Narasimhulu Parise, learned counsel for the Petitioner and Ms. K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing the respondent/State. 4. Learned Assistant Public Prosecutor would submit that the investigation has been completed and a charge sheet has been filed in the case, showing the present petitioner/A.2 as absconding, and that a Non-Bailable Warrant has also been issued against him. It is further submitted that, suppressing the said facts, the petitioner has filed the present anticipatory bail petition. The learned Assistant Public Prosecutor, therefore, prays that this Court may pass appropriate orders. 5. Having regard to the submissions made and upon considering the material on record, this Court is inclined to dispose of the present Criminal Petition. 6. In the result, the Criminal Petition is disposed of. However, the petitioner is at liberty to work out his remedy in respect of the Non-Bailable Warrant issued against him by approaching the concerned Court by filing an appropriate application. Upon such application being filed, the learned Judge shall consider and pass appropriate orders as expeditiously as possible. Consequently, miscellaneous applications pending, if any, shall stand closed.
