JUSTICE PRAMIL KUMAR MATHUR Order 07/07/2026 1. The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.182/2026 registered at Police Station Anantpura, District Kota City for offences under Sections 316(2) and 318(4) of BNS, 2023. 2. Since all these bail applications arise out of common FIR, hence, they are being decided by this common order. 3. Heard learned counsels for the petitioners as well as learned Public Prosecutor and perused the material available on record. 4. Learned counsels for the petitioners contend that the petitioners have falsely been implicated in these cases. They submit that the petitioners have not been named in the FIR nor were their names disclosed in the statement of the complainant recorded under Section 180 of the BNSS. It is further submitted that as per the allegations contained in the FIR, the complainant was induced to transfer 10,000 USDT (cryptocurrency) pegged to the US Dollar. It is also submitted that as per the seizure memo, the said 10,000 USDT (cryptocurrency) has been recovered from the possession of the co-accused. It is contended that the present petitioners have no connection whatsoever with the said USDT and that they neither cheated nor induced the complainant to transfer the aforesaid amount of 10,000 USDT (cryptocurrency). Petitioners are behind the bars since 12.05.2026 though one case has been reported against petitioner-Vijay Singh however, in that case he is already on bail. The investigation/trial of the case will take considerable time, therefore, no fruitful purpose would be [2026:RJ-JP:25318] (3 of 3) [CRLMB-8572/2026] served by keeping the petitioners in further custody, consequently, the bail applications deserves to be allowed. 5. Learned Public Prosecutor has vehemently opposed the bail applications of the petitioners. 6. On consideration of the rival submissions and material available on record and in the light of submissions made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 7. Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Sumit Saingar S/o Ramlal, Vishnu Singh Urf Dev Thakur S/o Shailendra Singh & Vijay Singh S/o Ramgopal Singh be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that each of them shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
