26 Heard Mrs. S. Roy, learned counsel for the petitioner and Mr. P. Borthakur, learned Additional Public Prosecutor, Assam.
2. This is an application filed under Section 482 BNSS, seeking pre-arrest bail of the petitioners, namely, (i) Monir Uddin; (ii) Kala Mia and (iii) Ashok Uddin, who are apprehending their arrest in connection with Bilaipur P.S. Case No. 09/2026 registered under Sections 331(2)/64(1)/62/351(1)/3(5) of the BNS, 2023.
3. It is submitted by the learned counsel for the petitioners that since charge sheet in the case has already been submitted, the petitioners shall appear before the learned Trial Court and apply for regular bail.
4. Accordingly, this pre-arrest bail application is disposed of with a direction that the petitioners may appear before the learned Trial Court within a period of 10(ten) days from today and in the event of filing any bail application seeking regular bail, the same shall be considered in accordance with law.
5. It is further provided that no coercive action shall be taken against the petitioners, during the period of 10(ten) days from today or appearance of the petitioners before the learned Trial Court, whichever is earlier.
6. This pre-arrest bail application accordingly stands disposed of.
