04/05.02.2026 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Chanho P.S. Case No.159 of 2024, registered for the offence under Sections 191(2), 191(3), 190, 126(2), 127(2), 115(2), 117(2), 118(2), 109, 132, 121(1), 121(2), 324(4) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 read with Section 3 of Prevention of Damage to Public Property Act, 1984, pending in the Court of the learned Judicial Magistrate, 1st Class, Ranchi.

Learned counsel appearing for the petitioners submits that petitioner no.1 has lodged Chanho P.S. Case No.158 of 2024 against Pappu Kumar Sahi, who has assaulted brother of petitioner no.1, namely, Basant Bhagat, who succumbed due to injury later on. He further submits that the villagers about 500-600 were moving towards the house of Pappu Kumar Sahi and in the meantime, the police intervened and pursuant to that the scuffle took place. He then submits that there are general and omnibus allegations of assault upon the informant. He next submits that the petitioners are having no criminal antecedent, as disclosed in paragraph 16 of this application.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there to make assault upon the informant.
5. Considering that petitioner no.1 has lodged Chanho P.S. Case No.158 of 2024 against Pappu Kumar Sahi for assaulting the brother of petitioner no.1, who succumbed due to injury later on and for that, the villagers about 500-600 moved towards the house of Pappu Kumar Sahi and in the meantime the Police has intervened and due to that scuffle took place and the petitioners have got no criminal antecedent, as disclosed in paragraph 16 of this application and the impugned order of the learned Sessions Judge is silent on the injury and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Ranchi in connection with Chanho P.S. Case No.159 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
