Sarma, learned counsel for the applicants, who by means of this application has sought for modification/ alteration of the judgment and order date 04.01.2023 passed in WP(C)/5277/2021 and 505/2021. The modification is sought for taking aid of a circular dated 14.07.2016. It however transpires that the aforesaid order dated 04.01.2023 passed by this Court was upheld by the Hon’ble Division Bench in WA/35/2023 and the Hon’ble Supreme Court in the SLP No. 13033 of 2024 had dismissed the same vide order dated 10.07.2024. It also transpires that one of the parties to the appeal had filed review petition which was dismissed on 24.10.2024. Though this application has been presented in the form of an IA, this Court is of the view that in a disposed of matter, the scope of entertaining an IA is Page No.# 3/3 very limited. This Court has further noticed that the alteration is sought for on the strength of a circular dated 14.07.2016 which was very much in existence when the writ petition was adjudicated. Therefore, even assuming that the present application is an application for review of the order, the same would not meet the requirements which are prescribed for entertaining a review application as it clearly transpires that the applicant lacked due diligence of not placing an existing circular. This Court is also of the opinion that the present case would attract the doctrine of merger inasmuch as the order passed by this Court was upheld by a detailed order passed by the Hon’ble Division Bench. Under those circumstances, the instant petition is held to be not maintainable and accordingly dismissed. JUDGE Comparing Assistant
