Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 6 months and till date only 2 witnesses out of 11 witnesses cited in the charge-sheet has been examined. Learned advocate for the state submits that the total quantum of seizure in the present case is 83 kgs. of ganja. Having considered the same, I am of the view that the rigors of Section 37 of the NDPS Act is attracted. As such, I am not inclined to release the petitioner on bail. However, the State is cautioned that if within another six months the prosecution witnesses are not over, the petitioner would be at liberty to approach this Court with a fresh prayer for bail considering only the 2 detention of the case and no other case. With the aforesaid observations, CRM(NDPS)569 of 2026 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
