Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with DN Nagar P.S. Crime No.1109 of 2025 pending in the court of learned J.M.F.C., 10th Court, Andheri, Mumbai on the grounds stated. 3. The petitioner pleads for transit anticipatory bail. Ms. Bisoi, learned counsel for the petitioner submits that the petitioner should be allowed transit anticipatory bail in view of the decision of the Apex Court in Priya Indoria Vrs. State of Karnataka & others (2024) 4 SCC 749 referring to the allegations contained in the FIR, a copy of which is at Annexure-1. Recorded the submission of learned counsel for the State. As it appears, a case is registered in the court of learned J.M.F.C., 10th Court, Andheri, Mumbai in connection with a theft. As it appears from the FIR i.e. Annexure-1, the petitioner was working in a shop at Mumbai at the relevant point of time when theft had taken place. It is informed to the Court by Ms. Bisoi, learned counsel that one of the co-accused is already on bail. Considering the submission as above and nature of allegations revealed from the FIR i.e. Annexure-1, the Court allows transit anticipatory bail in favour of the petitioner for a period of six weeks so as to enable him to move regular bail before the court concerned or in the alternative, seeking pre-arrest bail within the above stipulated period. 4.
