The applicant has preferred this application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 12/2026, registered at Police Station – Dhourpur, District - Surguja (C.G.) for the alleged commission of offence punishable under Sections 108 and 351 of the Bhartiya Nyaya Sanhita, 2023. 2. As per the prosecution story, a merg intimation was lodged alleging that on 20.02.2026, the deceased was admitted to the hospital with a complaint of stomach pain, and during the course of treatment, she died ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.04.30 11:16:40 +0530 2 on 24.02.2026. During the investigation, the family members of the deceased stated that for the past nine months, the applicant had been pressurizing the deceased to marry him, however, the deceased refused, and due to such alleged threat and pressure, she committed suicide. Hence, the offence has been registered 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He submits that the present applicant has neither committed nor participated in any act which may amount to any of the offences herein mentioned above. He also submits that both the applicant and the deceased were in a love relationship for the past one year and intended to marry each other. However, since the applicant belonged to a different caste, the family of the deceased objected to their relationship. Out of anger and frustration, the deceased allegedly consumed some poisonous substance, and during the course of treatment, she died. However, in order to escape from the guilt and responsibility of the deceased’s death, her family members have made false allegations against the applicant, claiming that pressure for marriage from his side was the reason for the suicide. He further submits that even if the allegations are taken at their face value, no offence is made out under Section 108 of the B.N.S., as there was neither any direct nor indirect abetment by the applicant for the commission of suicide. The alleged proposal of marriage was out of love and, by itself, cannot be construed as a reason for committing suicide. He submits that the applicant has no criminal antecedents, hence he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that the applicant was continuously pressurizing the deceased to marry him for the past nine months, and due to his 3 persistent threats and harassment, the deceased was driven to commit suicide. Considering the seriousness of the allegations and the material collected during investigation, it is prayed that the bail application be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions advanced by learned counsel for the parties, the nature and gravity of the allegation, and taking into account the material collected during investigation, particularly the statements of the family members of the deceased regarding continuous pressure and threats allegedly extended by the applicant, this Court is not inclined to grant bail to the applicant at this stage. Without commenting on the merits of the case, the bail application filed by the applicant deserves to be and is hereby rejected. 7. Accordingly, the anticipatory bail application of the applicant – Chandrashekhar Yadav, involved in Crime No. 12/2026, registered at Police Station – Dhourpur, District - Surguja (C.G.) for the alleged commission of offence punishable under Sections 108 and 351 of the Bhartiya Nyaya Sanhita, 2023, is rejected.
