Petitioner has challenged order dated 01.01.2026 passed by Adjudicating Officer/Additional District Magistrate, Nainital under provisions of Food Safety and Standard Act, 2006. Petitioner has also challenged the consequential recovery citation issued by Tehsildar, Ramnagar on 23.07.2026 for recovery of ₹80,000/-. 4. Learned State Counsel submits that petitioner has remedy of filing appeal before Food Safety Tribunal under Section 70 of the aforesaid Act, and the order of the Tribunal is thereafter appealable under Section 76 of the said Act. 5. Learned counsel for the petitioner submits that limitation provided for approaching Food Safety Tribunal is only 45 days. Learned State Counsel, however, submits that notice regarding proceeding pending before Additional District Magistrate, Nainital was duly served upon petitioner. 7. Be that as it may, since petitioner has remedy of appeal under Section 70 of Food Safety and Standard Act, 2006., therefore, the writ petition is disposed of with liberty to petitioner to approach appropriate Authority. If petitioner files appeal within ten days from today, the same shall be heard and decided, ignoring the question of limitation, as per law. Only for a period of ten days, no coercive action shall be taken against the petitioner on the strength of impugned recovery citation.
